What Is a Boat Title Transfer?
A boat title is a legal document that proves who owns the vessel. When a boat changes hands — through a sale, gift, or inheritance — the title needs to be transferred to the new owner through your state’s titling agency.
In South Carolina, this means filing a BTR-1 form with the Department of Natural Resources (SCDNR).
What Happens If You Don’t Transfer the Title?
You Don’t Legally Own the Boat
Without a title in your name, you have no legal proof of ownership. If there’s ever a dispute — whether with the seller, an insurance company, or law enforcement — you’re in a weak position.
You Can’t Sell It Later
When it’s time to sell, the next buyer will want a clean title. If the title is still in someone else’s name, you’ll need to track down the previous owner (who may be unreachable) to complete the transfer before you can sell.
You Could Inherit Someone Else’s Problems
If the boat has an existing lien (a loan against it), the lienholder can repossess the vessel — even if you paid the seller in full. A proper title transfer includes a lien check that protects you.
Fines and Late Fees
Most states have deadlines for title transfers. In South Carolina, you have 30 days. After that:
- 31-60 days late: $15 penalty
- 60+ days late: $30 penalty
These aren’t huge amounts, but they add up — and they’re completely avoidable.
Insurance Issues
Many insurance companies require proof of ownership (a title in your name) to issue or maintain a policy. If something happens to the boat and you can’t prove ownership, your claim could be denied.

- Transfer the title immediately after purchase. Don’t wait.
- Get a bill of sale signed and (in SC) notarized. This is your proof of the transaction.
